Welcome to www.greenfieldgirls.org.za, from here onward referred to as the GGPS Website. The GGPS Website is owned solely by Greenfield Girls’ Primary School, from here onward referred to as the School. All access to and any use of the GGPS Website and any other Web page or Internet site established by the school is governed by the following disclaimers and limits on use. On access, these disclaimers and limits are automatically accepted by the user* without condition.

*The term “user” collectively refers to but is not limited to a parent/guardian acting on behalf of a minor, a minor who acts on his/her own accord and/or any natural person.

Email Disclaimer

The views and opinions included in any email using the Greenfield domain belong to their author and do not necessarily mirror the views and opinions of Greenfield Girls’ Primary School. The content of any email is confidential and intended for the recipient specified in the message only. It is strictly forbidden to share any part of messages with any third party without the written consent of the sender.

 

Disclaimer of Liability

Neither the School nor its website contributors shall be held liable for any improper or incorrect use of the information described and/or contained herein and assumes no responsibility for anyone’s use of the information. In no event shall the School, the School Governing Body or its website contributors be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to: procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, tort (including negligence or otherwise), or any other theory arising in any way out of the use of this website, even if advised of the possibility of such damage. This disclaimer of liability applies to any damages or injury, whether based on alleged breach of contract, tortuous behavior, negligence or any other cause of action, including but not limited to damages or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, and/or theft, destruction or unauthorized access to, alteration of, or use of any record.

Indemnification

The user agrees to defend, indemnify, and hold harmless, the School, the School Governing Body, its contributors, any entity jointly created by them, their respective affiliates and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys’ fees, arising out of the use of the GGPS Website and any Web page or Internet site established by the School.

Parental and Child Consent for Use of Media 

Throughout the school year photographs, videos or work of children or group activities will be included in the following media (of which parents have been urged to view the links provided for their approval):

  • The GGPS Website (www.greenfieldgirls.org.za)
  • Facebook Page (www.facebook.com/GreenfieldGirls)
  • Facebook Closed Group
  • In presentations for other educators
  • Local area media i.e. newspapers, etc.
  • Any other third party websites and/or facilities i.e. Flickr, OneDrive, Moodle, Google, YouTube, etc.

All the parents of children who have photographs, videos and/or classwork appearing on this site or any of the above-mentioned areas have not in any way expressed their disapproval or declined consent. If, however, for whatever reason a parent expresses disapproval, the School will obligingly remove material indicated from these platforms at the request of a parent. 

It is generally accepted as permissible and out of the School’s control if a child without parental approval appears in a photograph or video by chance due to being amongst a gathering of individuals. This might only occur where the photograph and/or video of a child is taken while other children are in the background.

Disclaimer of Warranties/Accuracies and Use of Data/Computer Viruses

Although the information found using GGPS Website has been produced and processed from sources believed to be reliable, no warranty expressed or implied is made regarding accuracy, adequacy, completeness, legality, reliability or usefulness of any information. This disclaimer applies to both isolated and aggregate uses of the information. The School provides this information on an “as is” basis. All warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, freedom from contamination by computer viruses and non-infringement of proprietary rights ARE DISCLAIMED. 

Changes may be periodically added to the information herein; these changes may or may not be incorporated in any new version of the publication. If the user has obtained information from the GGPS Website the user must be aware that electronic data can be altered subsequent to original distribution. Data can also quickly become out-of-date. It is recommended that the user pay careful attention to the contents of any metadata associated with a file, and that the originator of the data or information be contacted with any questions regarding appropriate use. If the user finds any errors or omissions, we encourage the user to report them to the School.

Construction of the disclaimers within and resolution of disputes thereof are governed by the laws of the Republic of South Africa.
